After a shooting late last year left her unborn baby dead, Birmingham, Ala., resident Marshae Jones has since recovered from her physical injuries.

Ebony Jemison, the woman accused of shooting her, was initially expected to face manslaughter charges. Further investigation reportedly revealed that it was Jones who initiated the confrontation, however, and a grand jury found sufficient evidence to charge her with manslaughter.

Lt. Danny Reid of the Pleasant Grove Police Department released a statement regarding the development:

“Let’s not lose sight that the unborn baby is the victim here. She had no choice in being brought unnecessarily into a fight where she was relying on her mother for protection.”
